Welcome to Drivian.io, a platform operated by Conic Solutions OÜ, Sepapaja tn 6, 15551 Tallinn, Harju maakond, Estonia (“Drivian”, “we”, “our”, or “us”).
These Terms and Conditions (“Terms”) govern your access to and use of the Drivian website, applications, dashboard, integrations, and related services (collectively, the “Services”).
By creating an account, starting a free trial, purchasing a subscription, or otherwise using the Services, you agree to these Terms.
If you do not agree with these Terms, you must not use the Services.
1. About Drivian
Drivian is an omnichannel business messaging and marketing automation platform designed to help businesses manage customer communications, campaigns, automation, contacts, and team workflows from a centralized dashboard.
Depending on your subscription plan and available integrations, the Services may include:
- Messaging through WhatsApp, Instagram, Facebook Messenger, Telegram, SMS, and other supported channels;
- A shared team inbox for customer conversations;
- Campaign and broadcast messaging tools;
- Contact management and segmentation;
- Visual automation and Flow Builder tools;
- Chatbots, automated replies, triggers, and workflows;
- AI-assisted content generation;
- Analytics and reporting;
- Team collaboration and conversation assignment;
- Website chat widgets;
- eCommerce and third-party integrations; and
- Other features introduced from time to time.
The availability of specific features, channels, usage limits, and integrations may depend on your selected subscription plan and third-party service availability.
2. Eligibility and Business Use
You must be at least 18 years old and legally capable of entering into a binding agreement to use Drivian.
If you use Drivian on behalf of a company, organization, agency, or other legal entity, you represent that you have authority to accept these Terms on its behalf.
You agree to provide accurate, complete, and current information when creating and maintaining your account.
3. User Accounts
You are responsible for:
- Maintaining the confidentiality and security of your account credentials;
- Keeping your account information accurate and up to date;
- All activities performed through your account and workspace; and
- Promptly notifying us if you believe your account has been compromised.
You may invite team members to your Drivian workspace where supported by your plan.
The account owner is responsible for managing team member access, permissions, and activities performed within the workspace.
You must not knowingly allow unauthorized persons to access your account.
4. Subscription Plans
Drivian offers paid subscription plans that may be billed monthly or annually, depending on the plan selected during checkout.
Each plan may include different:
- Contact limits;
- Conversation or messaging limits;
- Campaign limits;
- Team member limits;
- Automation and Flow Builder limits;
- AI usage limits;
- Integration access; and
- Other features or usage allowances.
The features, limits, billing period, and price displayed at the time of purchase form part of your subscription.
We may introduce, modify, or discontinue subscription plans in the future.
5. 7-Day Free Trial
Drivian offers a 7-day free trial on its subscription plans, unless a particular offer clearly states otherwise.
The free trial is intended to allow you to evaluate Drivian and determine whether the Services are suitable for your business before paying for a subscription.
Unless you cancel before the trial ends, your selected subscription will automatically begin and the applicable subscription fee will be charged using your chosen payment method.
You may cancel during the trial period to prevent the subscription from becoming paid.
We reserve the right to restrict repeated, fraudulent, or abusive use of free trials.
6. Payments
Subscription payments are processed through third-party payment processors made available during checkout, such as Stripe, PayPal, or other supported payment providers.
By providing a payment method and subscribing to a paid plan, you authorize the applicable payment processor to charge you according to your selected subscription and billing cycle.
Drivian does not directly store your complete payment card details.
Applicable taxes may be added where required by law.
Certain integrations or messaging providers may require separate third-party accounts, subscriptions, message charges, or usage fees. Unless expressly stated otherwise, such third-party fees are your responsibility.
7. Automatic Renewal
Monthly and annual subscriptions automatically renew at the end of each billing period unless cancelled before the next renewal date.
By maintaining an active subscription, you authorize recurring charges to your selected payment method.
You are responsible for cancelling your subscription before renewal if you do not wish to continue using the paid Services.
8. Cancellation
You may cancel your subscription at any time through your Drivian dashboard or by contacting us at [email protected].
After cancellation, you will normally retain access to your paid subscription until the end of the current paid billing period.
No additional subscription charges will be made after cancellation unless you subscribe again.
Cancelling your subscription does not automatically issue a refund.
9. Refunds
If you are not satisfied with Drivian following your initial paid purchase, you may request a refund within seven (7) days of the original paid purchase or first subscription charge.
Subscription renewals and recurring charges after the initial subscription period are generally non-refundable, except where otherwise required by applicable law.
Refund eligibility and processing are governed by our Refund Policy, which forms part of these Terms.
10. Messaging and Marketing Responsibilities
Drivian provides software tools that allow you to communicate with your own customers, contacts, subscribers, and audiences.
You are solely responsible for ensuring that you have the legal right and any required permission, consent, or lawful basis to contact each recipient.
You agree to comply with all applicable:
- Privacy and data protection laws;
- Electronic communications and marketing laws;
- Anti-spam requirements;
- Opt-out and unsubscribe requirements;
- Consumer protection requirements; and
- Rules imposed by messaging platforms, telecommunications providers, and other third-party services.
You are responsible for the content, timing, frequency, recipients, and purpose of messages sent through your account.
Drivian does not provide legal permission to contact any individual merely because the platform technically allows a message to be sent.
11. Third-Party Messaging Platforms
Drivian connects to third-party communication platforms and APIs that may include Meta services such as WhatsApp, Instagram and Messenger, as well as Telegram, SMS providers, and other messaging services.
Your use of those channels is also subject to the rules, policies, restrictions, and terms imposed by the applicable third-party provider.
Third-party providers may independently:
- Approve or reject accounts or phone numbers;
- Restrict messaging functionality;
- Reject message templates;
- Apply rate limits;
- Filter or block messages;
- Suspend accounts;
- Modify their APIs;
- Change pricing; or
- Discontinue functionality.
Drivian does not control these decisions and cannot guarantee continued access to any particular third-party channel.
We are not responsible for account restrictions, suspensions, message rejection, delivery failures, or other actions taken by third-party providers.
12. Message Delivery
While Drivian is designed to facilitate reliable messaging, we cannot guarantee that every message will be successfully sent, delivered, read, or responded to.
Message delivery may be affected by factors outside our control, including:
- Third-party APIs;
- Mobile carriers;
- Internet connectivity;
- Recipient settings;
- Blocked numbers or accounts;
- Spam filtering;
- Provider rate limits;
- Platform outages; or
- Changes to third-party services.
Delivery, open, response, conversion, or engagement statistics displayed within Drivian should not be interpreted as guarantees of future results.
13. User Content
You retain ownership of the messages, media, contacts, campaign content, files, and other information that you upload, create, transmit, or manage through Drivian (“User Content”).
You grant Conic Solutions OÜ a limited, non-exclusive license to host, store, process, transmit, format, and otherwise handle User Content only as reasonably necessary to:
- Provide the Services;
- Deliver messages and automation;
- Maintain and secure the platform;
- Provide technical support;
- Prevent abuse or fraud; and
- Comply with applicable legal obligations.
We do not acquire ownership of your User Content.
You represent that you have all rights, permissions, and lawful authority necessary to provide and process User Content through Drivian.
14. Contact and Customer Data
You may upload, import, synchronize, or otherwise process information relating to your customers, subscribers, leads, or other contacts.
You are responsible for ensuring that your collection and use of such information complies with applicable privacy and data protection laws.
This includes determining whether you have an appropriate legal basis for collecting, storing, importing, and communicating with your contacts.
Our handling of personal information is described further in our Privacy Policy.
15. AI-Assisted Features
Drivian may provide AI-assisted features, including tools for generating or improving campaign copy, messages, chatbot content, and other text.
AI-generated content may occasionally be inaccurate, incomplete, inappropriate, or unsuitable for your intended purpose.
You are responsible for reviewing AI-generated content before sending, publishing, or relying upon it.
Drivian does not guarantee the accuracy, legality, effectiveness, originality, or suitability of AI-generated output.
AI features must not be used to generate unlawful, fraudulent, deceptive, abusive, discriminatory, or otherwise prohibited content.
16. Third-Party Integrations
Drivian may integrate with third-party services used for messaging, eCommerce, analytics, payment processing, infrastructure, email delivery, AI functionality, CRM functionality, or other business purposes.
Examples may include Meta platforms, Telegram, SMS providers, Stripe, PayPal, Shopify, WooCommerce, BigCommerce, and other supported services.
Your use of third-party services may be subject to separate agreements between you and the applicable provider.
We are not responsible for the operation, security, pricing, policies, availability, or actions of third-party services that we do not control.
Changes made by a third-party provider may affect or discontinue certain Drivian functionality.
17. Acceptable Use
You agree not to use Drivian to:
- Send spam or unsolicited bulk communications;
- Contact people without the permissions required by applicable law;
- Ignore valid unsubscribe or opt-out requests;
- Send unlawful, fraudulent, deceptive, threatening, harassing, or abusive content;
- Impersonate another person or business;
- Distribute malware, viruses, phishing content, or other harmful material;
- Violate intellectual property, privacy, or other rights of another person;
- Attempt to gain unauthorized access to accounts, systems, or data;
- Interfere with or disrupt the operation or security of Drivian;
- Circumvent usage restrictions, security controls, or subscription limits;
- Use automated systems in a manner that materially harms platform availability; or
- Use Drivian for any activity prohibited by applicable law or the policies of connected third-party services.
Importantly, bulk messaging itself is not prohibited when it is lawful and properly consented to. Drivian is designed to support legitimate broadcast and campaign messaging.
18. Suspension and Termination
We may suspend, restrict, or terminate an account where reasonably necessary because of:
- Violation of these Terms;
- Spam or messaging abuse;
- Fraudulent activity;
- Illegal activity;
- Payment fraud or repeated chargeback abuse;
- Security threats;
- Serious misuse of the platform;
- Requirements imposed by law or a competent authority; or
- Actions required to protect Drivian, our users, or third-party providers.
Where reasonably possible, we will attempt to resolve issues before permanently terminating an account.
We may take immediate action where necessary to prevent fraud, illegal activity, security threats, or significant harm.
Nothing in this section limits rights that cannot legally be excluded under applicable law.
19. Intellectual Property
Drivian, including its software, website, design, user interface, branding, trademarks, logos, documentation, graphics, and other original materials, is owned by Conic Solutions OÜ or its licensors and is protected by applicable intellectual property laws.
These Terms do not transfer ownership of any Drivian intellectual property to you.
You receive a limited, non-exclusive, non-transferable, and revocable right to use Drivian in accordance with these Terms for the duration of your account or subscription.
You may not copy, reproduce, distribute, sell, sublicense, reverse engineer, or exploit Drivian except where expressly permitted by law or by us in writing.
20. Privacy and Data Protection
Your use of Drivian is also governed by our Privacy Policy, which explains how personal information is collected, processed, stored, and protected.
The Privacy Policy forms part of these Terms.
You are responsible for complying with your own obligations under applicable privacy and data protection laws when using Drivian to process information relating to your customers or contacts.
21. Service Availability
We strive to provide a reliable and continuously available platform.
However, uninterrupted or error-free access cannot be guaranteed.
Temporary interruptions may occur because of:
- Scheduled maintenance;
- Software deployments;
- Infrastructure maintenance;
- Security updates;
- Technical failures;
- Internet connectivity issues;
- Third-party API outages;
- Messaging provider outages; or
- Circumstances beyond our reasonable control.
We will make reasonable efforts to restore affected Services as soon as practical.
Any uptime, performance, delivery, or reliability figures displayed on our website are informational unless expressly included in a separate written Service Level Agreement.
22. Changes to the Services
Drivian is an evolving software platform.
We may introduce new functionality, improve or modify existing features, change integrations, redesign portions of the platform, or discontinue functionality.
Where a change materially affects a paid Service, we will make reasonable efforts to provide notice when appropriate.
Third-party integrations may change or cease functioning without advance notice where the underlying provider modifies or discontinues its services.
23. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Drivian is provided on an “as is” and “as available” basis.
We do not guarantee that:
- The Services will always be uninterrupted or error-free;
- Every third-party integration will remain available;
- Every message will be delivered;
- Every feature will operate with every external provider;
- Data supplied by third parties will always be accurate;
- AI-generated content will be accurate or appropriate; or
- Use of Drivian will result in any specific level of sales, leads, revenue, engagement, or business performance.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
24. Limitation of Liability
To the fullest extent permitted by applicable law, Conic Solutions OÜ and its directors, employees, contractors, affiliates, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Drivian.
This includes, without limitation, losses relating to:
- Lost profits or revenue;
- Lost business opportunities;
- Lost customers;
- Loss of goodwill;
- Loss or corruption of data;
- Failed or delayed message delivery;
- Third-party API interruptions;
- Messaging platform restrictions or suspensions;
- Service outages;
- AI-generated content; or
- Actions of third-party service providers.
To the fullest extent permitted by applicable law, our total aggregate liability arising from or relating to the Services shall not exceed the amount you paid to Drivian during the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including liability for fraud, intentional misconduct, or mandatory consumer rights.
25. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Conic Solutions OÜ, its directors, employees, contractors, affiliates, and partners from claims, damages, liabilities, losses, costs, and expenses arising from:
- Your misuse of Drivian;
- Your violation of these Terms;
- Messages or content sent through your account;
- Your violation of applicable marketing, messaging, privacy, or data protection laws;
- Your infringement of another person's rights; or
- Claims relating to customer or contact data uploaded or processed through your account.
This obligation does not apply to the extent a claim results directly from our own unlawful conduct.
26. Force Majeure
Conic Solutions OÜ shall not be responsible for delays or failures caused by events beyond our reasonable control.
Such events may include natural disasters, war, civil unrest, governmental actions, internet failures, telecommunications failures, cyber incidents, power outages, infrastructure outages, labor disputes, or failures affecting third-party service providers.
Where reasonably possible, we will work to restore the Services as quickly as circumstances permit.
27. Changes to Pricing
We may change subscription prices or plan structures from time to time.
Price changes will not retroactively alter charges already paid.
Where required, we will provide reasonable notice before a price change applies to an upcoming renewal.
If you do not agree with a new subscription price, you may cancel your subscription before the new price takes effect.
28. Changes to These Terms
We may update these Terms from time to time to reflect:
- Changes to Drivian;
- New features or integrations;
- Changes to subscription offerings;
- Changes in applicable laws or regulations; or
- Changes to our business operations.

The “Last updated” date at the beginning of these Terms will be revised whenever the Terms are updated.
Where required by law or where changes are material, we may provide additional notice through Drivian or by email.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms, subject to any rights available under applicable law.
29. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Estonia, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of Drivian shall be subject to the jurisdiction of the competent courts of Estonia, unless applicable mandatory consumer protection laws provide otherwise.
Nothing in these Terms limits any mandatory legal rights available to you under applicable law.
30. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
The affected provision shall, where possible, be interpreted in a manner that most closely reflects its intended purpose while remaining legally enforceable.
31. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it in the future.
32. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Conic Solutions OÜ regarding your use of Drivian.
They supersede prior terms, representations, or agreements relating to the Services.
